Obviously, no "Cloud" in the near future, if at all, with all of the potential legal complications law firms would face.

HOW THE PREDICTIVE CODING ACTUALLY WORKS (OR DOES NOT WORK)

Hi, Guys,

Finally, how predictive coding perfects document reviewing. Or, does it?

Supposedly, the process is fully transparent. It starts with a review of a small subset of the total document population.

The documents in the subset are coded responsive or non-responsive, or some such, by the Law Firm Attorneys directly involved in the case.

Thereafter, the Law Firm Attorney-coded subset is used to “train” the predictive technology to automatically classify the larger remaining document population.

The predictive technology selects the documents to be reviewed by the Contract Attorneys, according to the parameters set by the Law Firm Attorney Reviewers.

Thus, the particular documents given to Contract Attorneys to review have already been selected by the Law Firm Attorneys. In other words, they are not "cold" documents as one would expect.

Law Firms are of the opinion that inasmuch as only a small percentage of the documents need to be manually reviewed, by its costly Law Firm Attorneys, to develop a subset for the litigation technology to classify, significant time and cost savings are evident.

Some of those cost savings experienced by Law Firms include the use of cost-effective Contract Attorneys that perform the document reviews.

Too bad Law Firms do not pass some of those savings on to the rate of pay of the valuable Contract Attorneys.

Below is a pretty clear picture of the document review process now in use by most large law firms, possibly, even the McDermott firm.

When the law firm hires a predictive coding service, the law firm’s Attorneys are totally responsible for the success or failure of the project.

The predictive litigation service’s process combines the judgment of experienced Attorneys with the patented automated document classification technology.

The law firm Attorneys most familiar with the case matter, drive the review process by “training” automated document classification technology.

The whole idea is to make large-scale document review more cost effective, consistent, and accurate.

Supposedly, the automated document classification technology, effectively:

Enhances the accuracy and consistency of review

Reduces the cost of document review

Minimizes the number of documents for manual review

Increases the speed of document review

You would think that this process would be the perfect solution to avoiding a McDermott situation.

Cloud computing encompasses platforms, infrastructure and software delivered over the Internet, instead of residing on local computers.

The legal profession lagged behind in adopting cloud computing technologies.

It's has yet to be determined whether lawyers stayed out of the "clouds" due to ethical obligations to protect client confidentiality and safeguard their data or because of law firms' inherent tendency to adhere to precedent and do things, "the way it's always been done."

Therefore, cloud computing made little headway within the legal industry -- until now.
